Terms and Conditions for Sierraenter

Article 1 (Purpose)
The purpose of these Terms and Conditions is to stipulate the details of the implementation and compliance regarding the US travel contract entered into between Sierraenter (hereinafter referred to as the "Company") and the traveler.

Article 2 (Obligations of the Company and the Traveler)

  1. To provide safe and satisfactory travel services to the traveler, the Company must faithfully perform its duties in the planning and execution of the travel, including travel mediation, guidance, transportation, and accommodation.

  2. For a safe and enjoyable trip, the traveler must actively cooperate in promoting harmony among travelers and maintaining the travel order established by the travel agency.
     

Article 3 (Definitions)
The types and definitions of travel are as follows:

  1. General Tour and Package Tour: A tour conducted by the Company by recruiting travelers through advertisements or other means, with predetermined travel destinations, itineraries, transportation and accommodation services to be provided to travelers (hereinafter referred to as "Travel Services"), and travel fees.

  2. Custom Tour: A tour planned and executed by the Company based on the overall travel conditions (transportation, accommodation, sightseeing, etc.) desired by the traveler (individual or group).
     

Article 4 (Composition of the Contract)

  1. The travel contract consists of the Travel Contract Agreement (attached), these Travel Terms and Conditions, and the Travel Itinerary (or Travel Description).

  2. The Travel Itinerary (or Travel Description) must include the daily destinations, sightseeing details, transportation, frequency of shopping, accommodation, meals, details of services provided by the travel agency, and notes for the traveler.
     

Article 5 (Formation of the Contract)
When a traveler applies for travel to the Company verbally, by phone, mail, or document, and the Company confirms the application according to prescribed procedures, the travel contract is deemed to be established when the traveler pays a deposit equivalent to 30% of the travel fee to the Company at the time of contract execution. (Note: Please refer to Article 10, Clause 3 regarding standard deposit rates).

Article 6 (Special Conditions)
The Company and the traveler may enter into special agreements in writing within the scope that does not violate relevant laws and regulations.

Article 7 (Deemed Delivery of Contract and Terms)
If the Company and the traveler enter into a travel contract via the Internet, the Contract, Travel Terms and Conditions, and Travel Itinerary (or Travel Description) shall be deemed to have been delivered.

Article 8 (Cancellation of Contract Due to Unfulfilled Minimum Participants)

  1. If the Company cancels the travel contract due to a shortfall in the minimum number of participants, it must notify the traveler at least 7 days before the departure date.

  2. If the Company fails to notify the traveler within the period specified in the preceding paragraph and cancels the contract due to a shortfall in participants, it must refund the deposit already paid and compensate the traveler with one of the following amounts:

    • Notification 1 day before departure: 20% of the travel fee

    • Notification on the day of departure: 50% of the travel fee
       

Article 9 (Refusal to Enter into a Contract)
The Company may refuse to enter into a contract with a traveler if any of the following applies:

  1. When it is recognized that the traveler may cause a nuisance to other travelers or hinder the smooth execution of the trip.

  2. When travel is deemed difficult due to illness or other reasons.

  3. When the stated maximum number of participants has been exceeded.

  4. When the minimum number of participants listed in the itinerary has not been met.
     

Article 10 (Travel Fee)

  1. The travel fee in the travel contract includes the following items. However, items 1 through 9 are amounts the traveler must pay directly at the destination, but the Company may collect and pay them on behalf of the traveler for their convenience:

      1. Fares for transportation such as aircraft, ships, and trains (based on standard fares).

      1. Transfer bus fares between airports, stations, piers, and hotels.

      1. Accommodation and meal expenses.

      1. Guide expenses.

      1. Various taxes required during the trip.

      1. Domestic and international airport and port taxes.

      1. Tourism promotion development funds, etc.

      1. Admission fees for tourist attractions listed in the itinerary.

      1. Other costs according to individual contracts.

      1. Travel mediation fees.
         

  2. The travel fee in the travel contract does not include the following items. However, for custom tours, this is subject to mutual agreement:

      1. Personal expenses during the trip (communication fees, customs duties, all tips, laundry fees, personally added food and beverages).

      1. All expenses that must be paid according to a doctor's diagnosis due to the traveler's illness, injury, or other reasons during the trip.

      1. Expenses incurred by exceeding standards or regulations (additional charges for single room use, oversized baggage handling fees, etc.).

      1. Costs not specifically stated in the travel itinerary.

      1. Various travel processing fees (passport stamp fees, visa fees, etc.).
         

  3. The traveler must pay a deposit (30% of the travel fee) to the Company at the time of contract execution. The deposit is treated as part or all of the travel fee or compensation for damages.

  4. The traveler must pay the remaining balance of the travel fee (excluding the deposit) to the Company at least 7 days before the travel departure.

  5. The traveler must pay the travel fee through a method designated by the Company (credit card, international wire transfer, cash, etc.).
     

Article 11 (Changes in Travel Fee)

  1. If the fares payable to transportation or accommodation facilities increase or decrease by 5% or more compared to the time of contract execution, or if the foreign exchange rate applied to the travel fee fluctuates by 2% or more, the Company or the traveler may request an increase or decrease in the travel fee within that range.

  2. If the Company increases the travel fee pursuant to Paragraph 1, it must notify the traveler 15 days before the start of the trip.
     

Article 12 (Conditions for Changing Travel Conditions and Fee Settlements)

  1. The travel conditions specified in Articles 1 through 11 may be changed only in the following cases:

      1. When both parties agree it is unavoidable for the traveler's safety and protection at the traveler's request or due to local circumstances.

      1. When the purpose of the trip cannot be achieved due to natural disasters, war, government orders, or strikes/closures of transportation or accommodation facilities.

  2. If the travel fee is adjusted due to a change in travel conditions under Paragraph 1 or a change in the travel fee under Article 11, the adjustment must be settled (refunded) before departure for pre-departure changes, and within 10 days after the trip ends for changes during the trip.

  3. If damages occur due to changes in travel conditions not specified in Paragraph 1, or due to contract cancellation or termination under Articles 13 or 14, settlements must be made before departure for pre-departure occurrences, and within 10 days after the trip ends for occurrences during the trip.

  4. If the traveler fails to receive services included in the travel fee (accommodation, meals, sightseeing, etc.) due to their own circumstances after departure, they cannot claim a refund for the corresponding amount. However, if the trip is terminated prematurely, it will be handled in accordance with Article 15.
     

Article 13 (Compensation for Damages)

  1. If the Company or local travel agents intentionally cause damage to the traveler, the Company must compensate the traveler.

  2. If the traveler's itinerary is disrupted because the Company fails to obtain the necessary passport, visa, re-entry permit, or various certificates due to its own fault, the Company must compensate the traveler with the amount received for proxy procedures.

  3. The Company must compensate the traveler for damages suffered due to delayed arrivals or traffic congestion of transportation such as aircraft, trains, or ships caused by the Company's intention or negligence. However, this does not apply if it is not the Company's intention or negligence.

  4. The Company shall not be exempt from liability for loss, damage, or delayed delivery of the traveler's baggage unless it proves that the Company or its employees did not neglect their duty of care regarding the receipt, delivery, and storage of the baggage.
     

Article 14 (Cancellation of Contract Before Departure)

  1. The Company or the traveler may cancel this travel contract before departure. In this case, the resulting damages will be compensated according to the 'Consumer Dispute Resolution Standards':

    • Notification 8 days before departure: Compensation of 10% of the travel fee

    • Notification 7 to 3 days before departure: Compensation of 20% of the travel fee

    • Notification 2 to 1 days before departure: Compensation of 30% of the travel fee

    • Notification on the day of departure: Compensation of 50% of the travel fee

    • Exceptions: If the tour cannot be conducted due to a shortfall in the minimum number of participants, the Company shall compensate the traveler in accordance with Article 8. Additionally, for Custom Tours, hotel fees are non-refundable if the hotel's policy states it is non-refundable.
       

  2. The Company or the traveler may cancel the travel contract without paying the compensation specified in Paragraph 1 if any of the following apply before departure:

    • 1) When the Company may cancel:

      • a. Cases falling under Article 12, Paragraph 1, Items 1 and 2.

      • b. When it is recognized that the traveler causes a nuisance to others or significantly hinders the smooth execution of the trip.

      • c. When the traveler cannot participate due to physical abnormalities such as illness.

      • d. When the traveler fails to pay the travel fee by the date specified in the contract.

    • 2) When the traveler may cancel:

      • a. Cases falling under Article 12, Paragraph 1, Items 1 and 2.

      • b. When the traveler cannot participate due to physical abnormalities such as illness (Must submit documentary evidence to the Company: i. Medical certificate, ii. Other necessary documents).

      • c. When a spouse or direct ascendant/descendant is hospitalized for 3 or more days due to a physical abnormality, making discharge before departure difficult (Applicable to the spouse or 1 guardian. Must submit: i. Family relation certificate, ii. Medical certificate, iii. Other necessary documents).

      • d. When the trip cannot be conducted according to the itinerary due to the Company's fault.

      • e. When it is recognized that continuing the trip is difficult due to an increase in the travel fee under Article 11, Paragraph 1.
         

Article 15 (Cancellation of Contract After Departure)

  1. The Company or the traveler may terminate this travel contract after departure if there are unavoidable reasons. However, the party terminating must compensate the other party for any damages incurred.

  2. If the contract is terminated under Paragraph 1, the Company must cooperate with the matters necessary for the traveler's return home. Any costs required for this that are not due to the Company's fault shall be borne by the traveler.
     

Article 16 (Company's Responsibility)
The Company shall be held liable if the Company itself, its employees, local travel agents, or their employees intentionally or negligently cause damage to the traveler in connection with the Company's duties specified in Article 2, Paragraph 1, from the start of the trip until arrival.

Article 17 (Traveler's Responsibility)

  1. The traveler is responsible for attending the pre-trip orientation hosted by the Company to verify the items in Article 10, Paragraph 1, to ensure the smooth progress of the trip.

  2. The traveler must faithfully cooperate with the travel guide's duties for the smooth progress of the trip.

  3. The traveler shall be liable to compensate the Company for any damages caused to the Company by the traveler's intention or negligence.

  4. The traveler is responsible for keeping their own valuables and belongings under their own responsibility. If a traveler's valuables or belongings are stolen during the trip, the traveler or insurance beneficiary must notify the relevant insurance company without delay upon discovering the incident and submit the following documents as soon as possible:

      1. Theft Confirmation Report

      1. Statement of Facts

      1. Other necessary documents
         

  5. The traveler is responsible for any problems arising from physical disabilities or illnesses not disclosed before the conclusion of the travel contract. However, if a physical disability or illness occurs during the trip, the traveler or insurance beneficiary must notify the relevant insurance company without delay and submit the following documents immediately:

      1. Accident Certificate

      1. Medical Certificate

      1. Statement of Facts

      1. Receipts

      1. Other necessary documents

  6. The traveler is responsible for verifying the baggage entrusted to the relevant airline before traveling by air.
     

Article 18 (Start and End of Travel)
The travel begins at the departure time of the transportation method and ends at the arrival time.

Article 19 (Duty of Explanation)
Important matters stipulated in the Company's contract are deemed to have been fully reviewed and understood by the traveler before making a reservation.

Article 20 (Miscellaneous Matters)

  1. Matters not specified in this contract or disputes regarding the interpretation of this contract shall be decided by mutual agreement between the Company and the traveler. If an agreement cannot be reached, it shall follow relevant laws and general customs.

  2. For travel to special regions where justifiable reasons exist, provisions differing from the Company's Travel Terms and Conditions may be established.
